It’s very common for people to work overtime and not be compensated, hence the term uncompensated overtime.

One of the things that we advocate for is keeping things as simple as possible until it’s necessary to make it more complicated. So if you win an SBIR phase one, I’m going to advise you to pay yourself and any employees on an hourly basis.

So I work 20 hours at $50 an hour. I’ll pay myself $1,000.

But once you hire your first full- time salaried employee, you’ve got a whole other bag of worms because now the government wants to see your written, uncompensated overtime policy.

What does that mean? Let’s pretend that we’ve just hired a new full-time employee, and we’re going to pay them $80,000 a year. I know there are either 2,080 or 2,088 hours in a year, but to make the math simple, let’s pretend there’s 2,000 hours in a year.

So this person is effectively making $40 an hour.

They’re going to fill out their time sheet, and let’s assume they spend 10 hours at $40 an hour. You’re going to turn around and bill the government $400 plus your overhead rate plus your fee. And the government is going to pay that bill.

And then, lo and behold, at the end of the year, this employee didn’t work 2,000 hours, they worked 2,500 hours. It’s very common for people to work overtime and not be compensated, hence the term uncompensated overtime.

So this $80,000-a-year person actually worked 2,500 hours. And if you do the math, that’s $32 an hour. Remember this is a cost reimbursable-type award.

Your cost is $32. You’ve billed the government $40. They want to know how you’re going to reimburse them for over-billing.
